We are unclear how Policy EN1 relates to Policy SC1 in the previous chapter.

However, we support the protection of habitats, biodiversity, blue and green infrastructure, and the natural environment in general.


Our response:

Comments and support noted. Policy SC1 relates to the impact of development on the local landscape character whereas Policy EN1 seeks to protect sites and habitats important for biodiversity. Whilst there may be some overlap between the two policies when assessing development proposals (for example, in relation to effects on tree cover) they cover two quite distinct policy areas.

Policy EN12 - The historic and cultural environment

We note Policies EN12 and EN13. We have some concern over the wording for conservation areas, which sits uncomfortably with the statutory duty for conservation areas under Section 72 of the Planning (Listed Buildings and Conservation Areas) Act 1990.


Our response:

Objection noted.
Section 72 of the Planning (Listed Buildings and Conservation Areas) Act 1990 states that 'special attention shall be paid to the desirability of preserving or enhancing the character or appearance of that area'.
Policy EN12 states that 'All development proposals, projects and activities will be expected to protect, conserve and where possible, seek opportunities to enhance historic assets and their settings...development should respect the historic landscape character and contribute to its conservation, enhancement, restoration, or creation of appropriate new features.'
Policy EN12 corresponds with the wording under Section 72 of the Planning (Listed Buildings and Conservation Areas) Act 1990.

Section 72 of the Planning (Listed Buildings and Conservation Areas) Act 1990 states 'special attention shall be paid to the desirability of preserving or enhancing the character or appearance of that area.'
Policy EN13.2 states that 'Significant weight will be given to the protection and enhancement of Conservation Areas). Development within should conserve, or where appropriate enhance, features that contribute positively...'
2.a - 2.e outlines the ways in which developments should preserve and/or enhance the areas.
The wording for Policy EN13 is in line with the wording under Section 72 of the Planning (Listed Buildings and Conservation Areas) Act 1990.

Policy MIN4 - Development criteria for mineral extraction

Representation Summary:

Policy WST2 clause (e) considers a range of impacts in terms of waste related development. We suggest that a similar clause is included for proposals in relation to future mineral extraction.


Our response:

Including a clause similar to Policy WST2 clause (e) in Policy MIN4 is not considered necessary when a range of impacts from minerals development are already detailed throughout Policy MIN4 and the supporting text. These include impacts on the natural and historic environment and on human health, including from noise, dust, vibration, visual intrusion, traffic, tip and quarry slope stability, differential settlement of quarry backfill, mining subsidence, increased flood risk, impacts on the flow and quantity of surface and groundwater and migration of contamination from the site, together with cumulative impacts.

Policy INF2 – Securing sustainable transport

Representation Summary:

We note Policy INF2. We support the emphasis on sustainable transport.

However, this is incompatible with the high levels of growth in Policies SS5 (St George’s Barracks) and H1 (reserve site H1.b) in an area with extremely limited public transport services.


Our response:

Comment Noted. For sites identified as Future Opportunity Areas, Development Plan Documents (DPD) would be prepared to develop detail of the delivery of an appropriate amount and range of infrastructure to support the uses and community on the site which must be delivered in tandem with or ahead of development. A DPD would also provide a detailed transport assessment including proposals for the delivery of sustainable transport and active travel linking the development with other key settlements in Rutland to ensure that reliance on the private car is minimised on the site.

We note that the policy refers to specific building regulations. We would suggest removing these references, as change to the building regulations in question will date the policies. Reference to the relevant building regulations could instead be made in supporting text.


Our response:

The supporting text to Policy H5 states that this policy is needed to secure the provision of M4(2) dwellings before the proposed introduction of the revised Building Regulations and to ensure that provision is made for M4(3) dwellings on large sites.
