Our response:

Policy CC1 aims to complement policies in Chapter 10: Minerals and Waste where the management of household waste across the County is dealt with. The principles of the Circular Economy are referenced in Chapter 10.

Representation Summary:

Residential development to incorporate renewable energy but must maintain character of the location. How do you address actual performance which falls short of design performance?


Our response:

Comments noted. Agree that weight must be given, in terms of design, to the character of the location of the development and to other Local Plan policies such as EN12 and EN13, and other guidance such as the National Design Guide (2021) and Design Guidelines for Rutland SPD (2021). It is suggested that RCC may wish to consider guidance notes and templates to assist in the drawing up and assessment of Energy Statements to help with the interpretation of the policy.

Policy CC6 - Water Efficiency and Sustainable Water Management

Representation Summary:

Residential and commercial development should address efficient water management. A policy on identifying and addressing water leaks should be included.


Our response:

Comments noted. Agree regarding commercial development. There is currently no standard in water efficiency in non-residential development and, without such a standard, this would not help to mitigate the problem of Rutland being classified as being in a serious water stressed area. Agree there should be a limit for non-residential development by encouraging new developments to achieve full credits for category Wat 01 of BREEAM unless demonstrated impracticable. (similar to approach in Greater Cambridge Local Plan). This is also highlighted in the Rutland Draft Water Cycle Study (2023) that states that: ‘Non-domestic consumption can also be reduced by encouraging new developments to be built to ‘Very Good’ or ‘Excellent’ BREEAM standards.’

Addressing water leaks is the responsibility of the Water Companies rather than through a policy in the Local Plan.

Policy CC8 - Renewable Energy

Representation Summary:

There should be recognition that Rutland, as a small county, may find it difficult to gain public acceptance, or find suitable areas for large scale energy proposals. There are practical limits imposed on land usage. Proposals for small to medium wind turbines throughout Rutland don't make sense around Rutland Water. This suggests the scope of the RWA should be enlarged to protect the unique landscape.


Our response:

Comments noted. RCC has declared a Climate Crisis and has committed to taking positive action to achieve net-zero including by considering renewable energy generation. Policy CC8 follows national guidance (NPPF para 160) by providing a positive strategy for renewable energy generation that maximises the potential for suitable development……while ensuring that adverse impacts are addressed appropriately. The Rutland Landscape Character Assessment (2022) would be used, together with Local Plan Policy SC1, to assess renewable energy applications. CC8 supports proposals where the impact on landscape character is acceptable, or can be made so. An assessment of impacts on landscape character (including cumulative impacts) would be carried out as part of the planning application process for renewable energy schemes. A Landscape and Visual Assessment would accompany a planning application for ground-mounted solar pv or wind turbine development.

Policy CC13 - Sustainable Travel

Representation Summary:

This seems to be dominated by charging points for electric vehicles and e-bikes. Where are proposals for improving the accessibility of public transport- such as buses and minibuses and cycle paths particularly in the towns but also connecting settlements, residential areas and towns?

Comments noted. Other policies in the Local Plan, namely SC3: Promoting good quality design, INF1: Infrastructure and connectivity, INF2: Securing sustainable transport and INF3: Walking and cycling seek to promote and enhance opportunities for other forms of sustainable transport, including public transport and cycle routes.

Policy SS5 – St. George's Barracks Opportunity Area

Representation Summary:

Whilst St Georges Barracks (SGB) is not currently considered as part of Regulation 18, the development of up to 500 houses will have an impact on RCC Planned housing provision. Will there be a corresponding adjustment (ie reduction) in the numbers set out in the current Local Plan outside SGB from 2026 or as and when SGB becomes available for development?

Consideration must be given to the impact of increased traffic onto the current rural road network connecting SGB to trunk roads.

The suggestion that the Masterplan should address “integration” of a development of 500 houses at SGB with Edith Weston, which only has 380 households in a geographically separate location is a difficult objective to meet in reality. Has RCC considered recognising it as a separate New Village?

Comments noted. Given that the masterplan for SGB would be a SPD or DPD considered through a review of the Local Plan, then any future allocation of housing on SGB would be taken into account in terms of housing land provision for the remainder of the county at the time of the review. Issues relating to transport impacts and impacts on local communities would form part of the masterplan.

Policy SS8 - Residential development in the open countryside

Representation Summary:

New build in the countryside for proposed gypsy sites should not be a general exemption but should be limited to identified sites. Policy H10 identifies such sites and subject to any conclusions drawn from the Regulation 18 consultation and changes made these should be defined in SS8.


Our response:

Objection noted.
Bullet point 4 of SS8 (now SS7) relates to Gypsy and Traveller sites, which would have to be in accordance with Policy H10.
Policy H10 sets out the requirements for these sites and the allocations proposed.

Having objected in SS4 to the removal of PLDs for smaller villages and hamlets, we therefore object to either affordable or rural workers housing outside of the existing PLDs particularly as part of mixed developments.


Our response:

The removal of PLDs from smaller villages and hamlets may have the unintended consequences of making it hard to identify what is 'within or adjoining villages' for the purposes of Policy H8.

Representation Summary:

Wording is ambiguous-”In areas outside Rutland Water Area” implies that inside the RWA the conditions which are then set out do not apply.


Our response:

Policy EN10 sets out the specific requirements for the type of proposals that are permitted in the Rutland Water area, whilst setting out the locations where self-serviced holiday accommodation is allowed. This is set out in the 'Why is this policy needed?' section below the policy.

Policy E9, provides a set of requirements that proposals for this type of accommodation have to meet.
