We would ask that a requirement similar to the second part of SS9 is included in this Policy.

Both SS8 and SS9 could share the conditions of the second part of SS9 about developments being required to demonstrate sub-para (a) to (h).

Any development within open countryside are subject to the additional policies as listed and would have to meet the requirements of these.

Policy SS11 - New agricultural buildings

Representation Summary:

We would ask that an additional condition be added to this Policy similar to SS9 para (c) about “not being detrimental to the character and appearance of the landscape, etc…”

We support the allocation of residential developments as laid out in Policy H1 and in particular the sites proposed for Larger Villages with 184 dwellings allocated against the 153 required.

Objection noted.
SS11 (now SS10) (a) states that agricultural buildings will be permitted in the countryside provided that their scale, siting, design, materials and use of landscaping minimise the visual impact on the landscape and ensure they are not prominent on the skyline.
Therefore, policy SS11 (now SS10) does ensure that proposed agricultural buildings in the countryside would not have a detrimental impact on the character or appearance of the landscape.

Policy H4 - Meeting all housing needs

Representation Summary:

The policy should be more robust on housing mix to require smaller homes, especially in Larger Villages where the existing housing stock is opposite to the requirement with mostly large houses. We would ask that a condition be added to this policy requiring developers to deliver houses generally in line with the distribution of a mix of bedrooms identified in the SHMA, 80% to be 4 or fewer bedrooms or provide a robust justification as to why this is either not possible or not required.


Our response:

There is policy and supporting text in Policies H3 and H4 regarding density and mix. Policy H4 included; "Development proposals for sites of 10 or more dwellings should provide a range of house types, sizes, and tenures to meet the general and specialist needs for housing in Rutland as identified in the latest Housing Market Assessment or other up-to-date evidence of local housing need." The HMA shows that the need is predominantly for two- and three-bedroomed houses. Parishes have the option of creating a Neighbourhood Plan to take account of local circumstances should they wish.

Policy H7 - Affordable housing

Representation Summary:

Many authorities require 33% affordable – During the Whole Plan Viability Assessment we would ask that an option of 33% Affordable Homes be considered.
There should be a mandatory requirement to provide either on-site or physically offsite. The current calculation for commuted sums does not provide sufficient finance for the Council to delivery the off-site accommodation . This needs to be reviewed.

Affordable rents should be in line with Local Rent levels and not 80% of market rents
Unfortunately this Policy is similar to the existing Local Plan Policy which has failed to deliver affordable homes and this Policy will not improve that situation.


Our response:

The adoption of social rent as a minimum standard (as opposed to affordable rent generally capped at the Local Housing Allowance level) would impact adversely on viability levels. This is supported by the Whole Plan Viability Assessment. In the context of this, it is not practicable to raise the level of affordable housing provision.

On sites of six to nine dwellings in villages, 30% affordable housing can generally be provided through commuted sums. On-site provision is impractical as housing associations will not take smaller sites, unless First Homes are used which do not meet the greatest need. Commuted sums are permitted on larger sites in exceptional circumstances. The level of commuted sums is discussed in the supporting text: "The Council's policy - and the calculation method used - is based on the commuted sum being broadly equivalent to the cost of on-site provision and will therefore contain elements of the construction and services cost as well as the land cost."

Policy E2 – Employment development on unallocated sites

We support the Policy for work-live units but would ask that there should be similar protection as in Barrowden and Wakerley Neighbourhood Plan Policy BW11 to ensure that the impact on the surrounding properties is minimised.

Policy E3 - Protecting existing employment land and premises

Policy E4 - Rural Economy

We would ask that the condition relating to Character etc in para (vi) be the same words as used in Policy E5 para (c).


Our response:

Policy E4 sets out the types of development which will be supported outside Oakham, Uppingham and the larger villages and then outlines the requirements of any proposals that come forward, including criterion vi.

Whereas Policy E5 specifically relates to sustainable farm diversification which sets out a number of policy requirements for proposals of this nature. It is considered that the wording for this policy is tailored to this specific type of development, whilst also including a requirement for the proposal to consider the impact on character and landscape as included in criterion c, as included also included in Policy E4.

Policy E7 - Fibre to the Premises (FTTP)

All new dwellings must either provide FFTP or where this is demonstrated not to be viable, industry standard ducting as close as possible to the existing telecom distribution points.

This is a “must” not a “should”.


Our response:

Comments noted. This policy only relates to commercial properties. However, the need to amend to wording in relation to 'ducting and other necessary infrastructure for the future delivery of FTTP', as set out in the policy to make this a firmer requirement is acknowledged and will be considered.

Policy E13 - Retail in the neighbourhood centres and larger villages

Representation Summary:

This policy is too general for Larger Villages. More detailed guidance is required as to what would be and not be acceptable. New retail provision should be for convenience and not destination shops.


Our response:

Noted. However it is considered that Policy E13 provides sufficient detail for retail development in larger villages and sets out what would be supported. Proposals for schemes that do not meet these requirements will not be supported.
