This Policy seeks to exceed the national requirement for 10% biodiversity net gain and thus poses an unreasonable burden on new development.


Our response:

Comments noted. Change from 15% to 10% as a higher percentage than the statutory objective of biodiversity net gain needs to be evidenced. In order for the Local Plan to be deemed sound this uplift above the mandatory level must be robustly evidenced.

Policy EN10 - Rutland Water Area

Representation Summary:

The RWA designated area should be reviewed or the Policy amended to recognise that there are opportunities for sustainable development other than the types listed in the Policy within the RWA. For example, the RWA includes land north of Whitwell Road, Empingham immediately adjacent to the physical fabric of the village. This area has no relationship with the Rutland Water foreshore.

Hereward Homes support the comments of the Parish Council.


Our response:

Noted. In this instance, upon consultation with our Landscape Consultant , slight adjustment to the boundary of the defined Rutland Water Area (RWA) around the Medical Centre allocation is considered appropriate to protect the statutorily protected status of the reservoir itself, and the valued landscape and wildlife interests and the established tranquil and undisturbed character of the wider RWA (whilst accommodating appropriate recreation and tourism needs).

The RWA boundary follows recognisable features such as roads, settlement edges (Planned Limits of Development) woodland or hedgerow field boundaries wherever possible. In some areas topographical features are followed. Inevitably there are some areas within the RWA that do not have a direct relationship to the reservoir, and other areas that may be screened by buildings or vegetation from some locations.

Our response:

Part eastern area identified on respondents Map 3 (incorrectly titled as Empingham) to be included in PLD as established curtilage.

Include only the eastern section as defined by single boundary line and including outbuilding. Area to west of this shall remain excluded from the PLD under the criteria of the methodology established by the PLD Review Study 2023.

Our response:

The PLD is to be amended around allocation H1.3 and the proposed Medical Centre site however the PLD around Empingham is considered the most appropriate and up-to-date delineation between the built framework of the village and surrounding open countryside, drawn in accordance with methodology established by the PLD Review Study 2023.

Policy EN1 - Protection of Sites, Habitats and Species

Representation Summary:

Hereward Homes strongly object to the Proposals Map designation of land at Barrowden Road, Ketton/Geeston
as a Candidate Local Wildlife Site as shown on the accompanying map.

The Council has no survey data relating to this privately owned site and has not approached, nor has the consent
of the landowner to undertake any such survey works. This would appear to be a legacy proposal from the
previous Local Plan which has not been taken forward. The ‘RUTLAND COUNTY – BIODIVERSITY ASSESSMENT’ evidence base for the Local Plan states at section 2.1.1 that ‘There are two non-statutory Local Wildlife Sites (LWSs) close to this Survey Area: the first, ‘Geeston Quarry LWS’ is situated approximately 290m south of the Survey Area, just the other side of the railway line.’ This is factually incorrect. The site is not a designated Local Wildlife Site. The evidence base which informs Policy EN1 is fundamentally flawed and the allocation as a Candidate/Potential Wildlife Site should therefore be removed to avoid the plan being found unsound. Furthermore, the site falls outside any of the defined Survey Areas in the evidence base.

Comments noted. This site is not only a Candidate Wildlife site, it has now been designated as a Local Green Space in the Made Ketton Neighbourhood Plan.

As well as removing the Policy EN1 allocation, Hereward Homes request that if the PLD's are retained then the boundary of Ketton/Geeston be extended. See attached map.


Our response:

The Planned Limits of Development (PLD) correctly identifies the extent of built development at Ketton / Geeston. The area identified as an extension is an area of semi-naturalised open space that does not meet the criteria for inclusion within the PLD under the methodology established in the PLD Review study 2023.
