The Council’s proposed approach as part of the Regulation 19 Plan has no justification, and results in an overly lengthy and unclear policy, which is ineffective and will only serve to delay development. The draft Policy is wholly contrary to the brownfield first principles set out in the NPPF and represents a failure to proactively bring forward land held in public ownership.

The Plan is unsound, contrary to paragraph 35 of the NPPF as it is not in line with national policy and the need to protect the significance of heritage assets and their setting, the policies/sites are not justified as there is no evidence to support their inclusion and the policies/sites will not be effective as there are no considered avoidance/ mitigation/ enhancement measures that could overcome harm to the historic environment

From our review of the Rutland Local Plan Consultation Draft Regulation 19, we are satisfied with the overall document and policies. We welcome continued engagement to support the progression of the Local Plan. We would expect to see the Infrastructure Delivery Plan (IDP), the modelling results, cumulative impacts on the Strategic Road Network (SRN) and any proposed mitigation, included in a Regulation 20 submission. This should be done before the examination in public takes place, which we understand is scheduled for 2025. We have also made a few recommendations to ensure that National Highways’ assets and interests are safeguarded within the policies of the Local Plan.
