Respondent: North Luffenham Parish Council

Representation Summary:

How does this policy relate / affect development under Class Q Permitted Development

Our response:

Response noted.
As mentioned in the policy description, certain conversions of agricultural buildings to dwellings can be done under permitted development - known as 'Agricultural Prior Approvals'. These are only dealt with under Schedule 2, Part 3, Class Q Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), and would not be covered by SS10 (now SS9).

Respondent: Colin Dodd

Representation Summary:

There are a number of ambiguous statements in planning policies SS9 and SS10.
The existing policies CS4, CS16 and SP7 provide a greatly level of clarity than the new policies and it is easier to see how a planning decision will be reached on planning applications. These new policies do not provide a robust or enforceable position with which to defend the county from unwanted development in the countryside.

The lack of clarity will lead to the ruination of rural Rutland, with farms becoming industrial estates warehouses and storage units, rather than being there to feed the nation and as custodians of the natural environment we all enjoy.

The new policies do not have the required level of clarity to provide a clear understanding of what development will and will not be classed as acceptable in the countryside.

Our response:

Objection noted.
Policy SS1 establishes the housing and employment needs for the plan period. It states that the majority will be focused within the Planned Limits of Development (PLDs) and through the allocation of sites within the plan. Policy SS10 (now SS9) will only be considered where there is an essential need. This is in line with the NPPF which recognizes this and para 84(c) states that acceptable development in the countryside for housing would re-use redundant or disused buildings and enhance its immediate setting. Additionally, para 88 (a) states that planning policies and decisions should enable the sustainable growth and expansion of all types of business in rural areas, both through conversion of existing buildings and well-designed, beautiful new buildings.

Received: 08/01/2024

Respondent: Morcott Parish Council

Representation Summary:

There is insufficient means to control the overall development of a series of agricultural buildings on the same site. This issue has recently arisen at Vine Farm in Morcott. The policy should be changed to specify that the same limits on development (floor space/number of dwellings) must apply when applying for or granting consent for new development following or replacing consent granted by Class Q Permitted Development. This would allow more control on the eventual size of a development made initially under Class Q but updated by replacement "improved” applications.
The numbers of Permitted Developments under Class Q or s80 must be counted in the statistics as “windfall” or other in meeting the housing need numbers.

Our response:

Policy SS10 (now SS9) only comes into effect where there is an essential need, and this need is demonstrated.
Para 89 of the NPPF supports that in some cases development will need to be located outside of existing settlements.
Developments approved under 'Class Q' are done under permitted development rights, where local and national planning policies do not come into effect.
Developments approved under Class Q of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) are included in the housing need statistics.
