The DIO are supportive of the thrust of emerging Policy SS6 and the support the Council are giving for these sites. To assist with the implementation of this policy and potential changes in Government agendas, it is suggested that the wording of the policy is amended to make reference to “the use of military bases and other secure residential establishments for operational or other purposes.” Clarification is required to confirm the works that need planning permission, or those which can be undertaken through Crown Permitted Development Rights.

Agree clarification on PD rights would be appropriate. Add in: The MOD, as a Crown body, also has permitted development rights on Crown Land whereby planning permission would not be required for certain types of development and so Policy SS6 would not be applicable.

This would still have an impact on local healthcare services eg Armed Forces families that live within the local ICB commissioning area will use local healthcare services. Community infrastructure support is therefore needs to be a consideration.

Comments noted. Support for additional community infrastructure, including healthcare facilities, would be achieved through the application of RCC’s Community Infrastructure Levy (CIL) which would apply to new residential development (potentially even when it constitutes permitted development). Local Plan Policy INF1 and RCC’s CIL document give further details.

Kendrew Barracks at Cottesmore, St George’s Barracks at North Luffenham and HMP Stocken all contain sports facilities which should be protected from being built on as laid out in paragraph 103 of the NPPF (2023). Community use of the sports facilities at Kendrew Barracks are included in the emerging Rutland Playing Pitch Strategy along with the need for their protection. There is a need to protect these existing sports facilities. Appropriate wording should form part of one of the criteria contained in this policy.

Comments noted. The protection of sports facilities is set out in para 103 of the NPPF and Local Plan Policy SC6. These would be used in the assessment of any application affecting sports facilities at the military sites.

Policy SS6 should include a requirement for a Transport Assessment (as in Policy SS7) if any proposal for development is beyond a certain size eg 25 dwellings. The Transport Assessment needs to include the wider impact on County roads and villages linked by the road network on the formulation of plans for any military or prison site including St George’s.

Comments noted. St George’s is not covered by Policies SS6 (now SS5) and SS7 (now SS6). Criteria c) and e) of SS6 (now SS5) require consideration of the highway impacts of development proposals, including impact of traffic on local communities. There are no definitive thresholds set out in national planning guidance that dictate when a Transport Assessment is required, as local factors will determine whether the Council considers a development will have a 'significant impact' on transport or not. They are usually required, however, in relation to major development which are more likely to be applicable under Policy SS7 (now SS6).

This policy does not include sufficient detail to ensure adequate assessment of any risk posed by land contamination is completed to ensure groundwater is not affected by contamination. We therefore suggest the below wording is also added into this policy.

‘A preliminary risk assessment done by a suitably qualified person should be undertaken in accordance with ‘ Land Contamination Risk Management’ as the first stage of assessing any risk posed by land contamination. Groundwater is vulnerable to pollution from activities including discharge of effluents to ground from drainage storage of hazardous substances, and previous land use. The Environment Agency’s approach to groundwater protection provides information on how the Environment Agency will take a risk-based approach to regulate activities that may impact groundwater resources and to prevent and limit pollution.’

Comments noted. Criteria h) of Policy SS6 (now SS5) considers contamination of soil and groundwater from former uses of the site. Add in reference to Local Plan Policy SC4 that considers contamination in more detail.
