Regulation 18 draft Local Plan

Representation ID: 4737

Received: 12/12/2023

Respondent: Miss Serena Solanki

Representation Summary:

Although I am in support of electric charging points. The policy focuses on car travel as a form of 'sustainable travel' and ignores bus services.
What will the council do to promote travel by bus? Will there be improved services and reliability to promote bus travel? This is a more sustainable form of travel than cars - i.e. mass transit

Our response:

Support noted. Policy CC13 relates solely to EV charging and e-bike parking. Other policies in the Local Plan, namely SC3: Promoting good quality design, INF1: Infrastructure and connectivity and INF2: Securing sustainable transport seek to promote and enhance opportunities for other forms of sustainable transport. The introductory chapter in the Local Plan makes it clear that the policies should not be read in isolation from each other and that it does not normally include cross-referencing between policies.

Representation Summary:

I support the policy, however this should not diminish the increasing need for improved rural public transport at a reasonable cost to the user. This would be more cost effective to the council and improve the lives of more people than charging points.

Our response:

Support noted. Policy CC13 relates solely to EV charging and e-bike parking. Other policies in the Local Plan, namely SC3: Promoting good quality design, INF1: Infrastructure and connectivity and INF2: Securing sustainable transport seek to promote and enhance opportunities for other forms of sustainable transport including rural public transport. The EV charging points required under Policy CC13 would normally be funded by the developer.

Respondent: Julie Gray

Representation Summary:

I am confused by this policy... should it not be called Electric Transport? which is all it seems to cover.
It certainly does not cover the wider implication of transition to net carbon Lifestyles and does not cover Sustainable Travel other than electric vehicles! There are too many assumptions - yes its slow, how do you know it will speed up - what else should be included in this policy to ensure Rutland achieves sustainable travel and net zero carbon!

Our response:

Comments noted. Agree the title of the policy is misleading. Suggest changing title to Electric Vehicle Charging and Electric Bike parking. Other policies in the Local Plan, namely SC3: Promoting good quality design, INF1: Infrastructure and connectivity and INF2: Securing sustainable transport seek to promote and enhance opportunities for other forms of sustainable transport including public transport.

Should the 'list of proposals' include those applications where the charging points are powered by PV roof panels and a battery?
Public transport, walking and cycling, are the most 'sustainable' ways to travel, not cars, even though they may be electric.

Our response:

Support noted. Agree to include ‘proposing charging points that are powered by solar PV panels either freestanding or on the associated building’. A change to the title of the policy to Electric Vehicle Charging and Electric Bike parking will help to clarify the extent of the policy. Other policies in the Local Plan, namely SC3: Promoting good quality design, INF1: Infrastructure and connectivity, INF2: Securing sustainable transport and INF3: Walking and cycling seek to promote and enhance opportunities for other forms of sustainable transport.

Representation Summary:

The policy is supported as far as it goes (but very limited in that it only concerns EV charging points, in themselves not very 'sustainable'). This policy needs to cross-reference Policy INF2.

Our response:

Support noted. The changing of the title of the policy to ‘Electric Vehicle Charging and Electric Bike parking’ will help clarify the extent of the policy. The introductory chapter in the Local Plan makes it clear that the policies should not be read in isolation from each other and that it does not normally include cross-referencing between policies.

"Proposals that include electric vehicle parking provision that exceeds or improves on the requirements set by Building Regulations will be supported"
This phraseology could be interpreted as any development that meets this policy will be supported, regardless of other attributes of the development

Our response:

Comments noted. Disagree as there then follow the series of bullet points giving examples of how proposals can exceed the requirements of the Building Regulations in terms of EV charging point provision.

Our response:

Comments noted. The changing of the title of the policy to ‘Electric Vehicle Charging and Electric Bike parking’ will help clarify the extent of the policy. Other policies in the Local Plan, namely SC3: Promoting good quality design, INF1: Infrastructure and connectivity, INF2: Securing sustainable transport and INF3: Walking and cycling seek to promote and enhance opportunities for other forms of sustainable transport, although the Local Plan has very little, if any, influence over bus times or rail fares.

But should this policy be renamed since it only covers electric vehicles? Public transport, walking and cycling, are the most 'sustainable' ways to travel, not cars, even though they may be electric, and Ketton is very poorly served by public transport.

Our response:

Comment noted. Policy CC13 follows national planning guidance (para 111 NPPF) which states that: ‘If setting local parking standards for residential and non-residential development, policies should take into account: …..e) the need to ensure an adequate provision of spaces for charging plug-in and other ultra-low emission vehicles.

No Local Plan can possibly be produced without such relevant information - which then can be closely tied to the proposed development sites - clearly showing whether those sites are viable from a Traffic Management and Sustainable Travel consideration. Given that there is no Traffic Management officer or Traffic Management Plan for Rutland it is impossible to see how any Local Plan can be considered at this time without such information.

Representation ID: 7228

Received: 07/01/2024

Respondent: Mr Harold Dermott

Representation Summary:

Unfortunately the data which this policy is based as in is out of date. You are not alone. Most of the decision makers in the UK are lacking experience and knowledge of electric vehicles (EV) and electric vehicle charging.

Whilst I am largely in agreement with CC13, your proposals to ‘go beyond’ Part S sound good but may well
not deliver what you are hoping for. There are simpler ways to achieve more. Your ‘Why is this policy needed??’ statement says: “A switch to electric
vehicles is underway but has been slow”, which is no longer true. EVs remained under 2% of new car sales from 2012 to 2017, 3% in 2019, but were 24% of all new car sales in 2023. EVs as a % of all cars on the road’ thus: 2017: 0.4%, 2019 0.8%, 2023: 4.5% The transition to EVs is happening NOW and not at some vague time in the future.

EVs as a % of all cars on the road’ are predicted to be, 2027: 10%, 2030: 20%, 2035:50% Please note that these projections, based on government data, mean that well within the life of this plan, half of all the cars on the road will be EVs. This clearly has implications for this Local Plan if it is to be fit for purpose in this area.

The wording of CC13 in the draft Local Plan says that RCC will support developers for ’proposing a higher ratio of charging points to parking spaces than the requirements set by the Building Regulations’ is not only commendable, but now essential.

Our response:

Support for Policy CC13 going beyond requirements of Part S of the Building Regulations regarding EV charging point provision noted. Agree to acknowledge that by 2035, the Government predicts that 50% of all cars on the road will be EVs. Substitute ‘but has been slow’ under ‘Why is this policy needed??’ with ‘and by 2035, it is projected that 50% of all cars on the road will be EVs.’ Also reference to Appendix 5 to be made: At end of para 4 on page 52 add in: ‘Appendix 5 of the Local Plan sets out the Electric Vehicle charging requirements for categories of commercial development.’
Part of representation relating to EV charging standards to be addressed under Appendix 5 (Parking Standards).

Limited charging points in Oakham and Stamford, people will only use electric cars for local trips, when they know they can charge their vehicle at home and return to home after trip from larger centres.

Our response:

Comments noted. Policy CC13 and Appendix 5 (Parking Standards) set out the requirements for EV charging points in relation to new development where planning permission is required. Permitted development rights also exist for EV charging points although the Local Plan cannot influence such provision. An extra sentence setting this out is suggested: At end of para 4 on page 52 insert: ‘In addition to the requirements set out in this policy, permitted development rights (where planning permission is not required) also exist for EV charge points, including in off-street public and private car parking areas.’

We note that the policy refers to specific building regulations. We would suggest removing these references, as change to the building regulations in question will date the policies. Reference to the relevant building regulations could instead be made in supporting text.

Our response:

Are facilities required for charging e-bikes/scooters safely, not just storing them? Should there be more emphasis on charging points in public car parks, supermarket car parks, etc.

How will progress towards net-zero be measured?

Our response:

Comments noted. The charging of e-bikes/scooters would normally be carried out indoors and so would fall outside the scope of the Local Plan. Policy CC13 supports proposals that go beyond the requirements of current Building Regulations and Appendix 5 sets out the standards for charging points in commercial developments. The provision of charging points in public car parks would fall outside the remit of the Local Plan as such provision would normally constitute permitted development.
