The Rutland County Council's Open Space Assessment 2023 reveals a significant increase in open space requirements from 2.95ha to 5.43ha per 1,000 population. Policy SC7 is not considered to be sound as it is not justified, not effective and not consistent with national policy for the following reasons:

This policy states that all new residential developments of 10 dwellings or more will be required to provide new or enhanced publicly accessible open space, to meet the needs of their occupiers in accordance with this policy and the standards set out in Appendix 3 and in any subsequently prepared SPD.

Again, this policy seems to be seeking to give Development Plan status to as yet unwritten SPDs which is not appropriate. The HBF recommends that this policy is amended to ‘and should take into consideration any guidance provided by subsequently prepared SPD’.

Policy SC7 primarily addresses the provision of new open spaces, with insufficient emphasis on protecting existing ones. The policy must explicitly outline how it will protect open spaces in accordance with the National Planning Policy Framework (NPPF).

The suggested requirements at parts g) and h) related to materials and equipment, and arrangements for RoSPA accredited inspection, as well as funding strategies and mechanisms for maintenance and management, should be dealt with via appropriately worded planning conditions and S106 obligations. The requirement for this information to be submitted at full application or reserved matters stage is unreasonable and not justified. The DIO maintain that these are not policy related matters and should be removed from the Policy, as it is currently unsound.
